THANDIZO ZAMBIA – TERMS OF SERVICE
1. Introduction
These Terms of Service (“Terms”) govern the use of the crowdfunding platform Thandizo Zambia (the “Platform”), accessible at [www.thandizozambia.org](http://www.thandizozambia.org), owned and operated by United Routes Movers and Logistics Limited, a company incorporated under the Laws of the Republic of Zambia (“the Company”).
By accessing or using the Platform, you (“User”, “Campaign Creator”, “Donor”, or “You”) agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with these Terms, you must immediately cease use of the Platform.
2. Definitions
For purposes of this Agreement:
“Platform” refers to the Thandizo Zambia website and related services.
“Campaign Creator” means an individual or entity who creates and manages a fundraising campaign on the Platform.
“Donor” means an individual or entity contributing funds to a campaign.
“Donation” means the voluntary transfer of money by a Donor to a Campaign Creator via the Platform.
“Mobile Money Providers” refers to MTN Mobile Money, Airtel Money, Zamtel Kwacha, and other approved payment processors.
“Platform Fee” means the five percent (5%) fee charged by Thandizo Zambia on each donation.
“Verified Campaign” means a campaign that has undergone KYC and content review by Thandizo Zambia before fundraising or withdrawal approval.
3. Eligibility
3.1 The Platform is available to natural persons aged eighteen (18) years or older, and to duly registered legal entities within the Republic of Zambia.
3.2 By creating an account, the User represents and warrants that they are legally capable of entering into binding agreements and that all information provided is accurate and truthful.
3.3 The Platform currently serves campaigns and users located within Zambia.
4. Account Registration and Verification
4.1 Users must register for an account using accurate and complete information.
4.2 Thandizo Zambia reserves the right to conduct Know Your Customer (KYC) verification, including requiring the submission of a National Registration Card (NRC), company certificate, or other identification documents.
4.3 Any false, misleading, or incomplete information may result in suspension or termination of the User’s account.
5. Campaign Creation and Restrictions
5.1 Campaigns must be lawful, truthful, and created for legitimate causes, including but not limited to education, healthcare, community development, innovation, and emergency relief.
5.2 Campaigns relating to political activities, election funding, or political party support are restricted and require prior written approval from Thandizo Zambia.
5.3 The Platform strictly prohibits campaigns involving:
Fraudulent or misleading content;
Money laundering or terrorist financing;
Violence, hate speech, or discrimination;
Adult, pornographic, or obscene material;
Illegal goods or services under Zambian law.
6. Donations and Platform Fees
6.1 Donations made through the Platform are voluntary and final, except as provided under the refund clause herein.
6.2 Thandizo Zambia shall deduct a five percent (5%) platform fee from each donation received.
6.3 Mobile Money Providers or third-party payment processors may apply additional transaction fees, for which Thandizo Zambia shall not be held liable.
6.4 Donors acknowledge that Thandizo Zambia acts as an intermediary facilitating payments between Donors and Campaign Creators.
7. Fund Holding and Withdrawal
7.1 Funds collected through campaigns shall be held in a dedicated trust or collection account until campaign verification and approval are completed.
7.2 Thandizo Zambia reserves the right to request additional documents before disbursing funds, including proof of campaign legitimacy or receipts for expenditure.
7.3 Once approved, funds shall be disbursed to the Campaign Creator’s verified Mobile Money or bank account.
7.4 Any misuse of funds shall constitute a breach of these Terms and may result in legal action, account suspension, and forfeiture of remaining funds.
8. Refund Policy
8.1 Donations are non-refundable, except in cases of proven fraud or misuse of funds as determined by Thandizo Zambia or any Law Enforcement Agency.
8.2 In such cases, refunds shall be processed to the original payment method, subject to Mobile Money Provider policies or Bank Transfers
8.3 Platform fees are non-refundable, even in cases where donations are refunded due to fraud.
9. Prohibited Conduct
Users are strictly prohibited from:
(a) Using the Platform for illegal, fraudulent, or deceptive activities;
(b) Impersonating any person or entity;
(c) Uploading viruses, malicious code, or conducting cyberattacks;
(d) Spamming or engaging in unauthorized solicitation;
(e) Violating the rights, privacy, or security of others;
(f) Interfering with the operation or performance of the Platform.
10. Mobile Money and Third-Party Services
10.1 All payments and withdrawals are processed through authorized Mobile Money Providers or third-party financial service partners.
10.2 Thandizo Zambia shall not be held liable for delays, transaction failures, or technical issues arising from these third-party systems.
10.3 Users agree to comply with the terms and conditions of the relevant Mobile Money Provider when using such services.
11. User Responsibilities
11.1 Users are responsible for maintaining the confidentiality of their account information.
11.2 Any activity occurring under a User’s account shall be deemed to have been conducted by that User.
11.3 Users must immediately notify Thandizo Zambia of any unauthorized use or breach of security.
12. Thandizo’s Rights and Remedies
12.1 Thandizo Zambia reserves the right, at its sole discretion, to:
(a) Suspend, terminate, or restrict access to any account or campaign;
(b) Remove or edit any content violating these Terms;
(c) Report any suspicious or illegal activities to law enforcement authorities;
(d) Modify, improve, or discontinue any part of the Platform without prior notice.
13. Limitation of Liability
13.1 Thandizo Zambia acts solely as an intermediary platform and does not guarantee the success, quality, or legitimacy of any campaign.
13.2 Donors contribute at their own discretion and risk.
13.3 In no event shall Thandizo Zambia, its directors, employees, or affiliates be liable for any indirect, incidental, or consequential damages arising out of the use or inability to use the Platform.
14. Data Protection and Privacy
14.1 Thandizo Zambia shall collect, store, and process personal data in accordance with the Data Protection Act, No. 3 of 2021 of the Laws of Zambia.
14.2 Personal information shall be used solely for account verification, campaign administration, and compliance purposes.
14.3 Thandizo Zambia shall not share personal data with unauthorized third parties without consent, except where required by law.
15. Governing Law and Dispute Resolution
15.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of Zambia.
15.2 Any dispute arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Zambia.
15.3 Parties are encouraged to first resolve disputes amicably through mediation or negotiation before seeking judicial remedies.
16. Amendments
16.1 Thandizo Zambia reserves the right to modify, amend, or update these Terms at any time without prior notice.
16.2 Continued use of the Platform following such amendments shall constitute acceptance of the revised Terms.
16.3 The most recent version of these Terms shall always be available on the official website.
